Yamcon Victory Over Meade Upheld In Appeal
Federal Court affirms District Court decision that SkyScout™ device does not infringe on Meade’s patent

RANCHO SANTA MARGARITA, Calif.—August 31st, 2006— The United States Court of Appeals for the Federal Circuit has ruled that Yamcon’s SKYSCOUT™ Personal Planetarium™ device does not infringe Meade Instrument Corporation’s (Nasdaq: MEAD) 5,311,203 patent. In their decision, the Court denied Meade’s appeal of the Summary Judgment issued in Yamcon’s favor last year by The United State District Court for the Central District of California.

“The consumers are the big winners today,” said Mike Lemp, CEO of Yamcon. “The SkyScout is forever changing the way people learn about astronomy, and despite Meade’s litigious tactics, the SkyScout is being produced, distributed and received with glowing reviews. The courts have once again halted Meade’s disruptive efforts and have allowed Yamcon, through its global partnership with Celestron, to make such a revolutionary, widely popular product available to consumers.”

Mr. Lemp added, “My hat is off to Celestron for showing the innovation and foresight to make the SkyScout commercially available. They are clearly the right partner for Yamcon.”

The Federal Appeals Court issued its Order on Friday, August 25th, ending litigation that started in October of 2004.
